Jill Cooper * * * CMS ISSUES PAYMENT UPDATES FOR 2010 The Centers for Medicare & Medicaid Services (CMS) announced July 1 proposed changes to policies and payment rates for services that would be furnished in 2010 by physicians, physical therapists, and other health care professionals who are paid under the Medicare Physician Fee Schedule (MPFS). Click here to read the CMS Fact Sheet on the Physician Fee Proposed rule. In the rule, CMS projects a rate reduction of -21.5 percent for calendar year 2010 due to the flawed update formula. In addition, the rule would refine practice expenses, remove physician-administered drugs from the definition of "physician services" for the purposes of updating the update formula, revise the Physician Quality Reporting Initiative (PQRI) program, and implement provisions in recent legislation adding new Medicare benefit categories for cardiac and pulmonary rehabilitation services. CMS will accept comments on the proposed rule until August 31 and will respond to all the comments in a final rule that will be issued by November 1. APTA will submit comments to CMS in response to the rule. AOA HOSPITAL ACCREDITATION STANDARDS COULD AFFECT PTS IN HOSPITALS New hospital accreditation standards developed by the American Osteopathic Association (AOA) could have implications for the delivery of physical therapy services in hospitals. The new AOA standards would require the physician to sign the therapy (physical therapy, occupational therapy, and/or speech language pathology) plan of care before therapy treatment may commence. This standard could prevent the delivery of timely care to Medicare beneficiaries and increase the administrative burden placed on therapists and physicians. Until we know what the full extent of the rules are going to be for EMR (electronic medical record) and payments (if you are treating Medicare clients initially), might not be a good idea to upgrade your IT systems. The Federal Trade Commission (FTC) announced this week that it will further delay enforcement of the "Red Flag" rule until November 1, 2009. This rule had been scheduled to go into effect August 1. Physical therapists and other health care providers who provide services to patients without requiring those patients to pay in full at the time of service will need to comply with new "Red Flag Rules," which require the establishment of an identity theft prevention program. The FTC reports that its staff will increase its efforts to educate businesses about compliance and to ease compliance burdens by providing additional resources and guidance.? These efforts will help clarify whether businesses are covered by the rule and what they must do to comply.
